2. What is the purpose of this notice?
This page describes how to manage theAz.website. Agr. La Spinona s.s. (Hereinafter referred to as "La Spinona") in relation to the processing of personal data of users who browse it.
The privacy policy is a notice that is also pursuant to Article 13 of the Legislative Decree. 196/2003 (Code concerning the protection of personal data) to those who interact with the website of "La Spinona", by going to https://www.laspinonabarbaresco.it/ the home page of the website "La Spinona", navigating within it and using any services.
The notice applies only to the site in question and not to other websites accessed via links.
Furthermore, this notice also draws from Recommendation no. 2/2001 of the European authorities for the protection of personal data, gathered in the Group established by Article 29 of Directive No. 95/46/EC, adopted on 17 May 2001, to identify some minimum requirements for the collection of personal data online and, in particular, the manner, timing and nature of the information that data controllers must provide to users when the latter connect to web pages, regardless of the purpose of their connection.
The present document draws on the contents of the Privacy Policy applied by the Authority for the protection of personal data in relation to the processing of personal data of users who connect to the official website www.garanteprivacy.it. It is indeed the intention of the director to align their privacy protection policies with the provisions of the "Code", as well as the cautions and procedures that the Guarantor has specified in its document on the Privacy Policy published on the official website of the Authority.
3. Purposes and Methods of Processing
Users' data is collected and processed for purposes connected or instrumental to the activities of "La Spinona" and are treated at the operational headquarters of the Data Controller and in any other place where the parties involved in the treatment are located.
"La Spinona" collects, stores and processes your personal data in order to supply the services offered on their web sites, or for legal obligations.
The Data Collector does not disclose processing operations of personal data defined as "sensitive" (personal data revealing racial or ethnic origin, religious, philosophical or other beliefs, political opinions, membership of political parties, unions, associations or religious, philosophical, political or trade union organisations and personal information disclosing state of health and sex life) or "judicial". The forms, both print and on-line, to be completed include data that is strictly necessary to comply with requests and the failure to specify said data does not allow to proceed with such requests, along with data of optional provision. The required data is generally marked with asterisks on forms available on-line, whilst on paper forms the notice itself clarifies which data is mandatory, the lack of which results in the request not being processed.
"La Spinona" will treat the data of its customers to send e-mails about its products similar to those already purchased, as permitted by the relevant Privacy Code, always giving the customer the possibility to oppose use of own personal data for this purpose. As provided by the legislation to protect consumers, "La Spinona" will use the data to send proposals for the purchase of its products to the postal address of the customer, provided that he/she has not stated otherwise. Finally, only if consent is expressed by the person on the phone, "La Spinona" may use data for the purpose of sales or for telephone surveys and market research.
Upon consent, the data may be used by "La Spinona" for sending e-mails about products and services of third-party advertisers, the list of which is available upon request, directly from "La Spinona".
The data of registered users will be processed for the provision of the information service via e-mail on "La Spinona" products which at the request of the user spontaneously, as well as for sending the newsletter when requested.
Finally, the data can also be processed to fulfill obligations under applicable law, regulation or EU legislation or, if required, will be made available to regulatory bodies.
"La Spinona", described above in greater detail, is the data controller within the meaning and for the purposes of the Privacy Code, as it can decide how and for what reasons, communicated in the specific notice, to collect and use personal data from the user. It is up to the company to choose which tools and safety procedures to activate to ensure the integrity, confidentiality and availability of the data.
"La Spinona", through the person in charge of personal data processing, will process the Users' Personal Information taking all necessary security measures to prevent unauthorized access, disclosure, modification or unauthorized destruction of the Personal Information.
The processing is carried out using a computer and/or telematic tools, using organizational procedures and with logics closely related to the aforementioned purposes.
The Data is processed for the period necessary to provide the service to the User, or the time required for the purposes described in this document, and the User can always request discontinuation of processing or deletion of data.
4. Voluntary provision of data
Apart from that which has been specified for navigation data, users are free to provide the personal information requested in the application forms available from the "Contact La Spinona" section to ask for further information material, place orders or make other enquiries following telephone contact with the company.
Absence of this data can make it impossible to fulfil the request.
It is, under no circumstance, obligatory to provide the data.
5. Users' Rights and methods of exercising those rights.
Users are guaranteed the rights of cancellation, modification, correction, integration of data already provided voluntarily. They have the right to ask for the blocking of data, to ask for it to be made anonymous or to object to their processing for legitimate reasons or if the User does not want to receive advertising materials (Article 7 Legistative Degree. 196/2003 and subsequent amendments. By exercising these rights it will be possible for the customer to control the use of his/her data even after its conferment.
Customers are, therefore, specifically entitled to:
1. the confirmation of the existence of personal data concerning Users and the intelligible communication of such data and their origin, and the logic and purpose on which the processing is based if with electronic instruments; the request can be renewed, unless there are justified reasons, after no less than ninety days;
2. the cancellation, making the data anonymous or the blocking of data processed in violation of the law;
3. updating, modifying or, where required, adding to the data;
4. to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning the customer;
5. to object to the processing of personal data for purposes of sending advertising material and interactive information.
These rights may be exercised at any time, by making a request, in any form, in writing, to the owner or manager of this site.
6. Persons to which the data of Users may be communicated as processors or appointed by the Owner and scope of diffusion
Users' data will be communicated to persons explicitly authorized by "La Spinona" and therefore appointed by the owner. In some cases, in addition to the owner, access to the data may be obtained by certain employees or managers involved in the management and fulfilment of the services required by users (administrative, commercial, marketing, legal, system administrators). 7. Security measures of the data collected from Users
"La Spinona" adopts suitable and preventative security measures to protect the confidentiality, integrity, completeness and the availability of your personal information. As required by the regulatory provisions governing the safety of personal data, we have developed technical, logistic and organizational methods that aim to prevent damage, even accidental loss, alteration, misuse and unauthorized use of data concerning you. Similar preventive security measures are taken by third parties (data controllers) that "La Spinona" entrusted processing operations of the data itself. On the other hand, "La Spinona" can not be held responsible for incorrect information sent by the User (e.g. accuracy of the e-mail or postal address or other personal data), as well as information that concerns the User and that was provided by a third party, even fraudulently.
"La Spinona" can not guarantee its users that the measures taken for the security of the website and transmission of data and information, limit or exclude any risk of unauthorized access or dispersion of data. Therefore, it cannot be held responsible for any breach of security, unless it is attributable to its negligence. It is recommended that each user be sure that their computer is equipped with software devices for the protection of the network transmission of data, both inbound and outbound (such as updated antivirus systems) and that their Internet service provider has taken appropriate measures for the security of the data transmission network (such as firewalls and spam filters)
8. Types of data collected and processed
Navigation data
During their normal operation, computer systems and software procedures used to operate this website acquire some personal data the transmission of which is implicit in the use of internet communication protocols.
This information is not collected with the intent of associating it with identified users although, inevitably, through the elaboration and association of data held by third parties, they could lead to the identification of users.
This category of data includes IP addresses or domain names of the computers used to connect to the website, the requested resources URI (Uniform Resource Identifier) notation, time of the request, method used to submit the request to the server, size of the file obtained in response to it, the numerical code indicating the server response status (successful, error etc.) and other parameters pertaining to the operating system and IT environment of the user.
